Any persons/organisation hiring our
equipment are responsible/liable for any damage or injuries
occurring from or as a result of misuse or reckless use. Persons
using the equipment / other items do so at their own risk. These guidelines are
for the safety of all persons using the inflatable and it is the
sole responsibility of the hirer to ensure they are adhered to. Our
company cannot accept responsibility for any damage or injury
to anyone using the equipment however caused.
For your information, safety and enjoyment we recommend the following:
1. The child castles / inflatables have an age limit of under 14 years old unless otherwise stated . Please ensure that no one over this age uses the inflatable - especially adults. This is due to safety, manufacturing and insurance reasons.
2. A responsible adult must supervise children at all times whilst on the inflatable.
3. Please do not allow anyone on the inflatable whilst inflating/deflating.
4. Children are not allowed to climb, sit or hang on the inflatable walls.
5. Do not allow children to bounce on the front safety step. The safety step is to assist users in getting on/off safely.
6. Ensure the inflatable is not overcrowded. Limit the number of users to allow enough room for each child to play safely. Try to avoid small and large children using the inflatable at the same time.
7. All shoes, badges and jewellery must be removed. We also recommend spectacles be removed.
8. No food, drinks or sweets to be consumed whilst on the inflatable to avoid both mess and possibility of choking.
9. No face paints, party poppers, streamers or silly string as these make a terrible mess and can also stain the inflatable for which you will be liable for payment to clean, repair or replacement.
10. No smoking, fires or barbecues to be used near or on the inflatable.
11. No pets to be allowed on or near the inflatable.
12. It is advisable to ensure that no one with any history of back or neck problems use the inflatable.
13. In the event of heavy rain it is strongly recommended that the inflatable is not used for safety reasons. When safe to re-use, towel dry any remaining wetness before allowing children back on.
14. Water fights are fun but do not spray water near the electric blower or on the items supplied.
15. Occasionally check that the inflatable is still securely pegged down, and there are no obstructions to the blower inlet.
16. Never switch the blower on and off whilst the inflatable is in use.
17. If the inflatable fails for whatever reason, evacuate immediately to prevent injury.
18. Please remember if any of the items are dirty or damaged when collected the hirer is liable for the full cost of repairs or cleaning costs.
BOUNCE TIME TERMS AND CONDITIONS OF HIRE -
These are in addition to our standard hire contract forms (If the Hirer is in any doubt as to the meaning of the following, a representative from Bounce Time should immediately be consulted before booking with us).
Definitions
1.1 The "Client" means the person/s, organization or company booking the equipment, act or entertainment with the "Company".
1.2 The "Company" means Bounce Time
1.3 'Dry / unmanned' hire is the hire of equipment for the 'client' to operate and supervise themselves.
1.4 'Wet / supervised' hire is the hire of equipment or entertainment accompanied by a representative of the 'company' to supervise use of the booked equipment or entertainment.
Bookings
2.1 All equipment remains the property of the company at all times.
2.2 By placing an order with us either verbally, by fax, in writing, on-line or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our contract terms and conditions of hire (a full list is available via www.bouncetime.co.uk/terms.htm)
2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfill our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
Prices, Retainer / Booking Fee & Balance Payments
3.1 All hires are subject to a booking fee of at least £25 or 25% which ever is greater and rounded up to the nearest £5.00 increment. (Fee is non refundable). This is in addition to any security deposit which may or may not be required.
3.2 The balance is to be paid in full by cash ( upon delivery), or via credit card 4.5% surcharge or debit card no surcharge on 1st transaction then £1.00 per additional transaction (American Express, foreign & Commercial Cards may incur more) prior to the event. If payment is to be made by cheque then it must be sent and cleared 14 working days prior to the event start date unless approved account facilities are held of which written credit terms would be given to the client a minimum of 28 days prior to the event. The company reserves the right to amend the surcharge should it be required but you will be informed at the time of booking / payment)
3.2a If there has been an error with the price on an invoice i.e. where we have quoted you one price but the invoice supplied was for less than the original quote supplied. Then Bounce Time reserves the right to make a charge to the credit or debit card used either for the booking fee or payment for the hire of the equipment. for the balance outstanding and an supplemental invoice will be provided. Likewise if we have over invoiced you then we will credit your account with the overcharge amount so you can use it against a future booking.
3.3 Terms for approved account clients will be strictly 7 days from invoice date unless agreed in writing by the company.
3.4 Advertised prices are subject to change without prior notification.
3.5 The company reserves the right to charge interest on all overdue accounts - at LIBOR + 8%.
3.6 The company reserves the right to charge a late payment fee of :- £40 for up to £1000, £70.00 for £1000 to £10000 and £1000 thereafter on all unpaid invoices.
3.7 All payments which are non honored will be subject to an additional charge of £25.00.
3.8 The company reserves the right to recover all legal & admin costs incurred.
3.9 All prices are NOT subject to VAT as we are not VAT Registered.
3.10 Retainer / Booking fee and Balance Payments are non refundable but subject to our Cancellation terms 4.1 we will issue a credit voucher code valid for 6 months from date of original event.
Cancellations
4.1 Any cancelled booking / order is subject to the following cancellation charges
More than 30 days prior to the event date there is no cancellation charge.
Within 30 - 15 days prior to the event date 25% of the contract total.
Up to 7 days before the event date 50% of the contract total.
Within 7 days prior to the event date 100% of the contract total.
4.2 This also refers to cancellations resulting in adverse weather or unsuitable set up conditions. By employing our services, you are not automatically entitled to a cooling off period under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 - Catering and Leisure Supplies for a time specific date. Cancellations can only be accepted in writing from the hirer, please send cancellations to: contact@bouncetime.co.uk
All cancellations or changes in bookings must be notified and can only be accepted in writing from the hirer, and will only be accepted from the franking date of the envelope upon receipt at our offices or receipt of e-mail to contact@bouncetime.co.uk
Bounce Time will aim to be as flexible as pragmatically reasonable. Therefore if you do encounter an issue with your event, please contact us and we will endeavour to find a solution.
If cancellation is due to bad weather for outdoor events (to be determined by the company) on the day then there is no charge providing we have not left the delivery depot.
Equipment
5.1 The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.
5.2 All sizes quoted are approximate
5.3 All goods remain the property of the company at all times.
5.4 The company reserve the right to amend or alter any product specifications without prior notice.
Site Location, Facilities & Conduct
6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded and set up.
6.2 Our delivery vehicles are to be allowed drive on access to the exact location to where the equipment is to be installed, or if to a building as close as possible to the installation location. The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable or due to insufficient space to install the equipment by our delivery personnel or if no prior written notice has been received, we may refuse to install the equipment if upon arrival it is found that the exact installation location is an unsuitable, unreasonable or an excessive loading distance from our delivery vehicle to the installation site, animal mess etc. Or the client has failed to notify us regarding obstacles such as stairs / steps etc. in such a case no refund will be given and the full contracted fees will be due to the company.
6.3 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.
6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that the guests or clients conduct endangers the safety of the guests, clients, themselves, the company's staff or the safety of the hired equipment. At no time will any level of abuse against our staff be tolerated. In all such cases no refund will be given and full contracted fees will be due to the company.
6.5 If the client wishes to charge their guests to use the equipment, they must provide a person to do so. At no time will our staff apart from dealing with the contract balance handle any other monies on the event unless agreed in writing prior to the event. If you require our staff to charge guests to use any of the equipment on hire then there will be a additional supervision fee of £10.00 per person per hour or part hour and this has to be agreed in writing prior to the event.
6.6 Free parking is to be supplied for our Vans / Cars / delivery vehicles or any other vehicles as required by the company or the company's staff. If free parking is not available then the cost of any parking will be invoiced after the event.
Liability & Insurance
7.1 The company's liability insurance covers use of the equipment only whilst booked on 'wet' hire (supervised by a representative of the company).
7.2 The client agrees to indemnify the company for any damage or theft of the company's equipment whilst on hire.
7.3 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
7.4 Any equipment booked on 'dry hire' (not supervised by a representative of the company). is not covered by the company's insurance policy and the client is responsible for suitable insurance cover.
Damages
8.1 If any of the hired equipment, accessories or trailer(s) is damaged or lost during the period of hire any security deposit paid will be utilised in discharge of or in part payment for repairs/replacements or lost hire contracts. The Hirer shall indemnify Bounce Time for the full cost of repair of any damage done to any equipment howsoever arising, which may occur during the period of the hiring as a result of the hiring. If the hirer has made payment by credit or debit card then Bounce Time reserves the right to make a charge to the credit or debit card used either for the retainer, booking fee or payment for the hire of the equipment, or to send an invoice for the amount to the registered hire address on the contract. Should payment not be received as per the invoice sent then we reserve the right to take legal action and all costs will be passed on to the hirer.
The company's liability insurance covers use of the equipment only whilst booked on 'wet' hire (supervised by a representative of the company) It does not cover damage or theft.
Miscellaneous
9.1
THE HIRER will, during the period of the hiring, be responsible for the supervision of the equipment (unless supervision is provided by the company), its care, safety from damage however slight or change of any sort, and the behaviour of all persons of all ages using the equipment whatever their capacity, including proper supervision of children to ensure children under school age use the equipment separately to older children or adults. The Hirer acknowledges that they have read and understand any relevant operating and safety instructions supplied with the equipment. The Company excludes any liability for injury loss or damage caused to any person using the equipment contrary to the terms and conditions of this Contract.
9.2 IN ALL HIRING CONTRACTS a refundable security deposit in the form of cash, cheque, credit or debit card may be required. Such deposit will be returned to the Hirer after 3 working days of return of the goods & inspection (unless it is not possible for The Company to inspect the items hired within 3 working days), unless the hired equipment, any accessories or trailer(s) have been damaged or lost during the period of hire and in such circumstances the said deposit will be utilised in discharge of or in part payment of those repairs/replacements or lost hire contracts. The Hirer shall indemnify Bounce Time for the full cost of repair of any damage done to any equipment howsoever arising, which may occur during the period of the hiring as a result of the hiring.
9.3 THE HIRER shall not use the equipment for any purpose other than that described in the hiring agreement, and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way, nor allow anyone onto the equipment wearing shoes, spectacles, carrying sharp objects, key-rings, metal studded clothing, belts or any other similar items which could cause damage to others or the equipment. No food or drink is to be consumed on the equipment. The hirer should not use the equipment outside in the event of high winds or wet conditions, must locate the equipment on flat ground and satisfy himself that there are not any sharp objects on the ground which may damage the equipment. The unit must also be suitably anchored at all times.
9.4 THE HIRER is responsible for ensuring that adequate safety barriers and notices are fitted around equipment if required. All equipment must be used in accordance with the HSE Guidance Note PM76/ Entertainment Sheet No 7, BS EN 14960:2013, all operating instructions issued by Bounce Time verbally or in writing and in a suitable safe environment. Any equipment hired for use on licensed premises shall be operated in a fenced off, glass free area. Notices indicating that the area is a GLASS FREE ZONE will also be required and all fencing is the sole responsibility of the hirer.
9.5 THE HIRER is required to provide access to a working and tested 240-volt 13amp power supply within 25 metres of the site. Each separate inflatable booked will require its own connection from the inflatable to the 240-volt 13amp wall socket. If the unit is hired with a generator, the additional charge made is for the hire of the generator and is supplied on the basis of being un-fueled unless otherwise stated.
9.6 THE HIRER will provide the following site conditions. A level site for all equipment supplied, a minimum access width of 33 1/2 inches, ensure that the site is free from all debris, sharp objects, animal waste (if animal waste is found then Bounce Time will charge for the ground sheet used providing this will cover all animal waste and this will then become your property at the end of the said hire or if excessive animal waste is found or you refuse to pay upon delivery for the ground sheet then Bounce Time will cancel the booking and full payment will be required) and within 50 meters of the delivery vehicle. If the site is outside of this distance, the hirer will provide an adult person to assist in the setting up and packing away of all equipment. If no person is available at the event, an additional charge of £50 may be levied against the security deposit if taken or you will be required to pay at the time of delivery at the discretion of Bounce Time.
9.7 IF ANY UNIT is returned outside the hire period for whatever reason an additional charge of £50.00 per item per day, daily hire charge or lost hire contracts whichever shall be the greater, will be payable by the Hirer to Bounce Time for each day or part day until the unit comes into the possession of Bounce Time.
9.8 IN ALL HIRING CONTRACTS the Hirer or their agent when asked will be required to produce 2 proofs of their identity and address. This will only be accepted in the form of Driving Licence, Utility Bill (dated within 3 months, mobile phone bills not accepted) or Passport.
9.9 undamaged condition unless he/she brings to the attention of Bounce Time once setup and doing a walk-round inspection with a Bounce Time employee and any faults noted by the Hirer upon the reverse of the hire contract. Any fault not reported within this time will be deemed to be the responsibility of the hirer.THE HIRER shall be deemed to have inspected the equipment, (accessories and trailer(s) if supplied) and to have agreed that it is supplied in good
9.10 FOR EQUIPMENT delivered to site, any delay with regards to meeting the client after the contracted arrival time will be charged at an additional £15.00 per fifteen minutes waiting time incurred. This will be rounded up to the nearest fifteen minute time period. Should we have to leave to for full our other delivery commitments and then return then there will be a re-delivery charge applied also.
9.11 PUBLIC LIABILITY INSURANCE is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol and/or not following instructions given by Bounce Time and its staff.
9.12 failure to provide this will render any claims null and void.IN THE EVENT of an accident occurring, full written details must be recorded including, name and address of injured party, circumstances of accident, date and place of incident and a copy of the report to be sent to Bounce Time within 48hrs of the accident
9.13 AT THE END of the hiring the Hirer shall be responsible for leaving the equipment in a clean and tidy condition otherwise Bounce Time shall be at liberty to make an additional charge. If the Hirer fails to return the equipment in a clean and tidy condition Bounce Time are entitled to levy a further charge of £30.00 per unit per hour or part hour for the cleaning and servicing of the equipment, and any loss of hire costs.
9.14 IN THE EVENT of the equipment or any part thereof being rendered unfit for the use for which it has been hired, Bounce Time shall not be liable to the Hirer for any resulting loss or damage whatsoever. Any refund offered for unusable equipment will be entirely at the discretion of Bounce Time and will be made in writing before any payment will be made.
